These Terms and Conditions govern your access to and use of the EzyRent mobile application, website (www.ezyrent.org), and all associated services (collectively, the 'Platform'). By downloading the application, creating an account, or using any feature of the Platform, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Platform.
EzyRent is operated by EZYMULTIVERSE ESTATE INVESTMENT & PROMOTIONS LTD, a company incorporated under the laws of the Federal Republic of Nigeria with registration number RC8287723, hereinafter referred to as EzyRent, we, our, or us.
1.Definitions
In these Terms and Conditions, the following definitions apply:
- 'Platform' means the EzyRent mobile application, website, and all associated digital services.
- 'User' means any person who accesses or uses the Platform, including Tenants, Landlords, and Field Partners.
- 'Tenant' means a User who uses the Platform to search for, inspect, or rent a property.
- 'Landlord' means a User who lists a property on the Platform for the purpose of renting it to a Tenant.
- 'Field Partner' means an independent agent registered on the Platform who conducts property verifications, onboards Landlords, and facilitates rental transactions in exchange for commission.
- 'Escrow' means the secure holding of rental funds by EzyRent via our payment processor (Monnify) pending confirmation of a successful move-in by the Tenant.
- 'Inspection Fee' means the fee of 5,000 Naira charged to a Tenant when they book a physical property inspection.
- 'Platform Commission' means the percentage fee charged by EzyRent on a successfully completed rental transaction.
- 'Wallet' means the in-app digital wallet associated with a User's account for receiving and withdrawing funds on the Platform.
2.Eligibility and Account Registration
2.1Eligibility
To use the Platform, you must be at least 18 years of age, be a resident or citizen of Nigeria or another eligible jurisdiction, have the legal capacity to enter into binding agreements, and provide accurate and truthful information during registration.
2.2Account Registration
You are required to create an account to access the core features of the Platform. When registering, you must provide a valid name, phone number, and email address. You must submit a valid government-issued identity document for verification. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
EzyRent reserves the right to suspend or terminate any account where false, misleading, or incomplete information has been provided during registration.
3.Tenant Terms
3.1Tenant Responsibilities
As a Tenant using the Platform, you agree to:
- Use the Platform only for the purpose of finding legitimate rental accommodation.
- Pay the Inspection Fee of 5,000 Naira before any property inspection can be arranged.
- Confirm or dispute a move-in within 48 hours of the agreed move-in date. Failure to confirm or dispute within this period will be treated as a successful move-in and funds will be released to the Landlord.
- Not attempt to contact Landlords or Field Partners outside the Platform to arrange rentals that bypass the escrow system.
- Not provide false information about yourself, your rental intentions, or your financial status.
- Not use the Platform to facilitate or participate in any form of rental fraud.
3.2Inspection Process
All inspections are conducted by a verified Field Partner, not by the Landlord. The Inspection Fee is non-refundable once an inspection has been conducted, regardless of the outcome. If a scheduled inspection does not take place due to circumstances within EzyRent's control, the Inspection Fee will be refunded in full.
3.3Escrow Payment
When a Tenant proceeds to rent a property through the Platform, their rental payment is held in escrow by EzyRent via Monnify. Funds are released to the Landlord only after the Tenant confirms a successful move-in through the application. If the Tenant disputes the move-in, EzyRent will investigate the matter and make a determination within 7 business days. EzyRent's decision in a disputed move-in is final and binding on both parties.
3.4Refund Policy for Tenants
A Tenant is entitled to a full refund of their escrow payment in the following circumstances:
- The property is found to materially differ from the listing at the time of move-in, as verified by EzyRent.
- The Landlord has rented the property to another party before the Tenant's confirmed move-in date.
- The Landlord is found to have provided false identity or ownership information.
EzyRent is not liable for any refund where the Tenant cancels after confirming move-in or after the 48-hour dispute window has closed.
4.Landlord Terms
4.1Landlord Responsibilities
As a Landlord using the Platform, you agree to:
- Provide accurate and truthful information about your property, including size, condition, amenities, and location.
- Submit valid proof of property ownership or authority to let before any listing is approved.
- Submit a valid government-issued identity document for verification.
- Not list a property that has already been committed to another tenant outside of the Platform.
- Not attempt to collect rent payments outside the Platform's escrow system from any Tenant who found the property through EzyRent.
- Ensure the property is available and in the condition described at the time of the Tenant's move-in.
4.2Listing Approval
All property listings are subject to physical verification by a Field Partner before they are made visible to Tenants on the Platform. EzyRent reserves the right to reject, remove, or suspend any listing that does not meet our verification standards, contains false information, or violates these Terms.
4.3Platform Commission
On the successful completion of a rental transaction facilitated through the Platform, EzyRent will deduct a platform commission of between 7.5% and 10% of the total rental value from the funds held in escrow before releasing the balance to the Landlord. The applicable commission rate will be communicated to the Landlord at the time of listing. This commission covers the cost of verification, escrow processing, Field Partner compensation, and platform operations.
4.4Withdrawal
Landlords may withdraw funds from their Platform Wallet to their registered bank account at any time. A withdrawal processing fee of 100 Naira applies to each withdrawal. EzyRent processes withdrawal requests within 1 to 3 business days. EzyRent reserves the right to hold funds pending resolution of any dispute raised by a Tenant against a Landlord's property or transaction.
4.5Prohibited Landlord Conduct
Landlords must not:
- List properties they do not own or have no authority to let.
- Double-list a property on and off the Platform simultaneously.
- Accept or solicit direct payments from Tenants sourced through EzyRent, bypassing the escrow system.
- Intimidate, threaten, or harass any Tenant, Field Partner, or EzyRent staff member.
- Interfere with the inspection process conducted by Field Partners.
5.Field Partner Terms
5.1Field Partner Status
Field Partners are independent contractors, not employees of EzyRent. Nothing in these Terms creates an employment relationship, partnership, or agency between EzyRent and any Field Partner. Field Partners are solely responsible for their own tax obligations arising from income earned through the Platform.
5.2Field Partner Responsibilities
As a Field Partner, you agree to:
- Conduct thorough and honest physical inspections of all properties you verify and upload.
- Collect and submit accurate identity and ownership documents from Landlords during the onboarding process.
- Not accept payments from Landlords or Tenants outside of the Platform in connection with any listing or transaction.
- Not verify or upload a property you have a personal financial interest in beyond your Platform commission.
- Attend property inspections within the timeframe agreed with the Tenant.
- Report any suspected fraud, fake listings, or suspicious activity to EzyRent immediately.
5.3Field Partner Earnings
Field Partners earn income through the Platform in two ways:
- An Inspection Fee of 1,000 Naira per completed property inspection.
- A commission of 5% of the total rental value on every successfully completed transaction that the Field Partner facilitated.
Earnings are credited to the Field Partner's Platform Wallet upon confirmation of each qualifying event.
5.4Minimum Withdrawal
Field Partners must accumulate a minimum balance of 10,000 Naira in their Platform Wallet before initiating a withdrawal. This threshold is designed to support meaningful earning cycles and reduce processing costs. A withdrawal processing fee of 100 Naira applies to each withdrawal request.
5.5Termination of Field Partner Status
EzyRent reserves the right to suspend or permanently revoke a Field Partner's access to the Platform, and withhold pending earnings pending investigation, if the Field Partner is found to have submitted false property or landlord information, accepted bribes or unofficial payments, facilitated fraudulent listings, or violated any provision of these Terms.
6.Payments, Escrow, and Financial Terms
6.1Payment Processing
All payments on the Platform are processed through Monnify, a licensed payment processing provider in Nigeria. By using the payment features of the Platform, you agree to Monnify's applicable terms and conditions. EzyRent is not responsible for any delays, failures, or errors in payment processing that originate from Monnify's systems.
6.2Escrow Mechanism
The escrow fee charged by EzyRent is 2.5% of the total rental value on every transaction processed through the Platform. This fee is deducted from the funds held in escrow before the balance is distributed. The escrow fee is non-refundable once a transaction has been confirmed as successful by the Tenant or after the 48-hour confirmation window has expired.
6.3Disputed Transactions
Where a Tenant raises a dispute regarding a move-in within the 48-hour window, EzyRent will investigate and issue a determination within 7 business days. During the investigation period, the funds remain in escrow and no withdrawals may be made against them. EzyRent's determination is final and binding. Compensation for proven Landlord fault is limited to the refund of the Tenant's escrow payment. EzyRent does not assume liability for consequential losses, including alternative accommodation costs.
6.4Taxes
Users are solely responsible for any taxes applicable to their earnings or transactions conducted through the Platform. EzyRent does not deduct withholding tax or any other tax on behalf of Users unless required to do so by applicable Nigerian law.
7.Prohibited Conduct
The following conduct is prohibited on the Platform and may result in immediate account suspension, permanent ban, and referral to law enforcement authorities:
- Creating fake property listings or impersonating a property owner.
- Using the Platform to defraud any User, including collecting payments outside the escrow system.
- Uploading false identity, ownership, or verification documents.
- Manipulating the inspection or move-in confirmation process.
- Using automated bots or scripts to interact with the Platform.
- Attempting to reverse-engineer, hack, or gain unauthorised access to the Platform.
- Using the Platform for any purpose that violates Nigerian law, including but not limited to money laundering or financing of illegal activities.
- Harassing, threatening, or abusing any other User or EzyRent staff member.
8.Intellectual Property
All content on the Platform, including but not limited to the EzyRent name, logo, application design, written content, graphics, and software, is owned by EZYMULTIVERSE ESTATE INVESTMENT & PROMOTIONS LTD or its licensors and is protected under applicable Nigerian and international intellectual property laws.
Users may not reproduce, distribute, modify, or create derivative works from any Platform content without the prior written consent of EzyRent.
9.Limitation of Liability
EzyRent provides the Platform on an 'as is' and 'as available' basis. To the fullest extent permitted by applicable law, EzyRent disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
EzyRent's total liability to any User for any claim arising out of or in connection with the Platform shall not exceed the total fees paid by that User to EzyRent in the 3 months preceding the event giving rise to the claim. EzyRent is not liable for indirect, incidental, special, consequential, or punitive damages of any kind.
10.Dispute Resolution
All disputes arising from these Terms or the use of the Platform shall first be submitted to EzyRent's internal dispute resolution process by emailing legal@ezyrent.org. EzyRent will endeavour to resolve disputes within 14 business days of receipt.
If a dispute cannot be resolved internally, it shall be referred to arbitration under the Arbitration and Conciliation Act (as amended) of the Federal Republic of Nigeria. The seat of arbitration shall be Lagos, Nigeria. The language of arbitration shall be English.
Nothing in this clause prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.
11.Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Users submit to the non-exclusive jurisdiction of the courts of Lagos State for any matter arising under these Terms.
12.Changes to These Terms
EzyRent reserves the right to update or modify these Terms at any time. Where changes are material, we will provide at least 14 days' notice by email or through an in-app notification. Continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.
